This Privacy Policy applies to the information we collect about you in the course of our business, including through patriotlivingtrusts.com, any of our other websites, products, or services that include a link to this privacy policy, our products, and other related offerings operated by or on behalf of us, including our customer service features such as phone calls and chats. We refer to these products, services, and offerings collectively as the “Services.”

If you are using our Services, this policy applies to you. If you disagree with any aspect of this policy, please do not use the Services.

This Privacy Policy is incorporated into our Terms of Service and governs your use of Patriot Living Trusts’ services. When we use the terms “Patriot Living Trusts,” “we,” “us,” and “our,” this refers to Patriot Living Trusts and its subsidiaries and affiliates. For example, we may collect information directly from you when you create a living trust using the Services; when you submit information into our forms and questionnaires; and/or interact with technical or customer support via chat or phone.

  • Government-issued identifiers, such as your driver’s license, passport number, or other government identification.

  • Financial and transactional information, including your account number, credit card or other billing information, account balance when linked through a secure third party, account type, institution, ownership information, and purchase and transaction history. Note, your credit card information is processed by our payment processor; we do not collect or store this information.

  • Customer service interaction information, including messages submitted through online forms or email, and summaries or recordings of interactions with our customer service personnel.

  • Information you provide in connection with surveys, sweepstakes, or promotions, if you choose to participate.

  • Other information you upload to the Services or otherwise provide with your consent, such as uploaded documents, service reviews, or communications with us. In certain cases, this may include “sensitive personal information” as defined by applicable laws, to the extent you include such information in your living trust or upload it to the Service.

  • Information about third parties, such as beneficiaries, executors, guardians, and family members. This may include their full name, contact information, date of birth, and relationship to you. You are responsible for ensuring you have the appropriate authority to provide this information to us.

B. Information We Collect Automatically Through Technology When You Use the Services

When you use our Services, we, our service providers, and vendors may automatically collect certain information using third-party technologies, including cookies and similar tools. For additional information about these technologies, please see the Online Analytics and Advertising section below.

Information collected automatically may include:

  • Device data: IP address, MAC address, browser language, unique device identifiers, the state or country from which you accessed the Services, operating system, internet connection type and service provider, Wi-Fi network, software and hardware attributes (including device IDs, operating system, and browser type).

  • Usage data: Information about how you use our Services, including dates and times of access, browsing behavior, page visits, features used, clicks, cursor movements, searches, customer service interactions, and screen recordings.

C. Information We Collect From Other Sources

We may receive information about you from other users of Patriot Living Trusts. For example, when a user shares the contact information of another person through our shared access functions or estate planning documents, they confirm they have that person’s consent to share their information with us. We ask all users not to share anyone’s information without their consent or permission. If a user provides your personal information, they are responsible for obtaining the required consents.

We may also receive information about you from business partners, marketing partners, researchers, analysts, social media services, and other parties to supplement our records. If you log into our website or connect via a third-party network or platform, you authorize us to collect, store, and use information such as your name, email address, and location, consistent with your privacy settings on those platforms. To limit such sharing, you may adjust your settings on the third-party network.

D. Information Provided by Professional Partners

We may collect your personal information from third-party professionals who use our Services, such as financial advisors. These professionals may use our AI-powered tools to upload documents to our platform to facilitate providing our Services to you or on your behalf. This can occur whether you are an existing user, have been referred, or are a client of the professional. These professionals are responsible for obtaining your consent before sharing your information with us.

3. How We Use Your Information

We may use the information we collect for the following purposes:

A. To provide you with the services you requested

This includes assembling and delivering your personalized living trust documents, processing payments, verifying your identity, creating and administering your account, carrying out your requests throughout your use of the Services, and offering member support to ensure you get the answers you need and resolve any issues.

Please note that we also use the information you provide to notify the people you choose about your living trust. (This refers to the “Shared Access” feature, which only shares your living trust with your direct consent, to an email address you choose.)

This may also include providing concierge services where, at your express direction, our authorized member support personnel access your account to view or modify your information and documents on your behalf. All interactions related to this service may be recorded and stored for quality assurance and compliance purposes.

B. To communicate with you

We may contact you by email, telephone, or text message to keep you informed about your living trust, provide transaction or account-related messages, share Services and product updates, and notify you of changes to our terms, conditions, and policies.

C. For marketing, advertising, and analytics purposes

We may send you newsletters, promotional emails, surveys, and information about products, services, and promotions offered by us, our partners, and other organizations we collaborate with. This also allows us and our advertising partners to personalize content and ads you see on our Services or other websites and mobile apps. D. To personalize your experience

We customize certain features on the Services, remember your preferences, and provide an enhanced experience based on your activities and interests.

E. To improve our Services

This includes bug detection, error reporting, understanding user interactions with our Services and advertisements, improving usability and effectiveness, conducting research and analytics, and testing or creating new products, features, and services.

F. For our business operations

We use your information to maintain your account and for security, fraud prevention, and legal compliance. This includes detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity.

G. For other purposes with your consent

We may use your information for a particular purpose communicated to you, for which we will seek your consent in accordance with legal requirements.

We may combine information collected via the Services with information gathered automatically or from other sources and use this combined information as described in this Privacy Policy. Your browsing activity may be tracked across different websites and devices; for example, we may match your activity on your mobile device with that on your laptop. Technology partners may disclose data such as browsing patterns, geo-location, and device identifiers to facilitate this matching.

We also may aggregate or de-identify collected information in a way that it cannot reasonably be linked back to you or your device. De-identified or aggregated data may be used for any purpose, including research and marketing, and may be disclosed to third parties such as advertisers, promotional partners, and sponsors.

H. To improve and provide our Services using Artificial Intelligence

We use advanced technologies, including AI and large language models, to enhance internal workflows, assist with sales and marketing (such as qualifying leads), improve team efficiency, provide conversational support in customer-facing experiences (including AI-powered call center technologies), and perform document analysis and data ingestion when you or your authorized representative uploads documents to the Services.

Our use of AI tools is governed by strict data privacy and security protocols. We do not use your personal information to train or fine-tune external AI models. All information is handled in accordance with this Privacy Policy.

4. How We Disclose Your Information

We and our service providers disclose the information we collect from and about you in the following circumstances:

A. Vendors and Service Providers

We work with select third-party vendors to ensure we can provide our Services and operate our business. We may provide access to or disclose your information to these vendors. Their services include printing and mailing your living trust documents, facilitating filing of legal documents at your direction, connecting you with attorneys if you purchase attorney support, payment processing, financial data aggregation, product analytics, customer communication, error and performance monitoring, AI-powered communication and call center platforms, marketing, analytics, development, data hosting and storage, security, fraud prevention, research, and legal services.

B. Corporate Affiliates and Subsidiaries

We may share your information with our corporate affiliates and/or subsidiaries who are subject to this privacy policy.

C. Corporate Merger or Acquisition

We may sell, transfer, or otherwise share some or all of our assets, including your information, in connection with a corporate transaction such as a merger, acquisition, reorganization, or sale of assets. In such an event, you may receive notice if your data is transferred and becomes subject to a different privacy policy.

D. Legal Compliance and Protection

We may release your information when necessary to comply with the law, enforce our site policies, or protect our rights or the rights of others regarding property or safety.

A Note about Your Feedback

If you submit a testimonial, we may publish it on the Services. Any processing or disclosure of feedback and submitted content will follow our Terms of Service and any additional terms provided at submission.

We also use third-party services to send promotional emails to visitors to our website who may be interested in our products and services.

Online Analytics

We may use third-party web analytics services on our Services, such as Google Analytics. These service providers use technologies described in the “Information We Collect Automatically” section to help analyze how users use the Services. Information collected by these technologies will be disclosed to, or collected directly by, these providers who use the information to evaluate your use of the Services on our behalf.

Online Advertising

We strive to provide you with relevant, tailored advertising about our Services. We do not serve third-party advertisements to you while you use our Services. However, we work with online analytics and advertising partners to:

  1. Better understand the use of our Services to improve them; and

  2. Deliver Patriot Living Trusts advertisements tailored to you both on our Services and on third-party platforms.

To facilitate this, our partners may place cookies, pixel tags, and similar technologies on our Services. For example, we may use tracking pixels from third parties such as Meta to collect information about your activities on our Services to present you with more relevant advertising on other websites and social media platforms. These partners may use the information they collect to identify Patriot Living Trusts products you might be interested in and to recognize your device in order to show you relevant advertisements.

Additionally, we sometimes provide basic information we collect (such as email addresses) to service providers who may “match” this information in de-identified form to cookies, mobile ad identifiers, and other proprietary IDs to provide you with more relevant ads when you visit other online services.

We do not have access to, and this Privacy Policy does not govern, the use of cookies or tracking technologies placed on your devices to access our Services by non-affiliated third parties.

6. Children’s Privacy

Our Services are intended for use only by individuals who are over 18 years of age. We do not direct Patriot Living Trusts to children under the age of 18, and we do not knowingly collect or solicit information through the Services from any person under the age of 18. Our documents may allow you to enter information regarding your dependent children, but we do not collect that information without your direct consent. We restrict the use of any data you submit regarding your minor children to the specific business purpose of helping you create your living trust. We reserve the right to delete any information identified as having been provided through the Services from children under the age of 18 or about children under the age of 18 to the extent such information was not provided with the necessary consent.

7. Your Rights and Choices

In addition to the rights and choices described elsewhere in this Privacy Policy, you have the following rights regarding your personal information:

Depending on your jurisdiction, you may have the right to:

  • Be informed about the categories of personal information we collect or disclose about you; the sources of such information; the business or commercial purposes for collecting it; and the categories of third parties we disclose it to.

You also have the right to not be discriminated against for exercising these rights. Certain information may be exempt from such requests if necessary to provide services or comply with legal obligations. We take reasonable steps to verify your identity before fulfilling requests, which may include verifying your name and email address. You may designate an authorized agent to submit requests on your behalf with signed, written permission or power of attorney. We may verify the identity of the authorized agent before processing.

Marketing Communications

You may unsubscribe from marketing emails via the unsubscribe link in the emails or by emailing support@hesedheartholdings.com. To opt out of SMS/text messages, reply STOP. Processing your request may take some time. Administrative messages such as order confirmations or policy updates may still be sent. Mobile numbers collected solely through SMS programs will not be disclosed to third parties for marketing.

Notice of Right to Opt-Out of Sales and Targeted Advertising

Depending on your jurisdiction, you may have the right to opt out of the sale or sharing of your personal information for targeted advertising. We disclose information to unaffiliated third-party business partners or advertising providers to provide you with relevant ads or offers. Such disclosures may be considered “sales” under applicable laws.

Participation is voluntary, and terms of each program apply. Monetary value estimates of rewards consider revenue generated, expenses incurred, and product improvements resulting from the program.

8. Notice to California Residents

This section supplements our Privacy Policy with additional information for California residents about our information collection and use practices as required by the California Consumer Privacy Act, as amended (“CCPA”). In this section, the terms “personal information” and “sensitive personal information” have the meanings set forth in the CCPA.

Under the CCPA, “sharing” is defined as targeting advertising to a consumer based on their personal information obtained from their activity across distinct online services, and “selling” is defined as disclosing personal information to third parties in exchange for monetary or other valuable consideration. We engage in activities that constitute both a “sale” and “sharing” of personal information under these definitions. Specifically, as described in our “Business Partner Programs” section, we sell personal information to our business partners for compensation. We also share personal information with our advertising partners for cross-context behavioral advertising.

You have the right to opt out of these sales and sharing activities by using the privacy settings tool accessible via the cookie icon on our website.

You have the right to opt out of Patriot Living Trusts’ sale or sharing of your personal information for online analytics and advertising by using the privacy settings tool on our website or the “Do Not Sell or Share My Personal Information” toggle within our mobile app’s settings menu. We also honor legally recognized browser-based opt-out signals, such as the Global Privacy Control, in accordance with our legal obligations.

Other CCPA and California Rights

  • Right to Limit: The CCPA allows you to limit the use or disclosure of your “sensitive personal information” if used for certain purposes. We do not use or disclose sensitive personal information other than for business purposes for which you cannot opt out under the CCPA.

  • Retention of Personal Information: Please see the “Retention” section below.

Do Not Track (“DNT”)

DNT is a privacy preference users can set in certain web browsers to inform websites and services they do not want certain information about their webpage visits collected over time and across websites. Except as otherwise described herein regarding legally required browser-based opt-outs, we do not respond to browser-initiated DNT signals, as there is currently no industry-wide framework for such signals. California “Shine the Light” Disclosure

The California “Shine the Light” law gives California residents the right to opt out of the disclosure of certain categories of personal information with third parties for their direct marketing purposes, or to receive a cost-free means to opt out. 9. Transmission of Information to Other Countries

Please note that Patriot Living Trusts is located in the United States and provides the Services, processing your data in the United States. Patriot Living Trusts may subcontract the processing of your data to, or otherwise disclose your data to, service providers and trusted business partners in countries other than your country of residence, including the United States, in accordance with applicable law. By submitting your information to us, you agree to the transfer, storage, and processing of your personal information in countries other than your country of residence, including but not necessarily limited to the United States.

10. Securing and Storing Your Data

We use a variety of technical, physical, and organizational security measures designed to protect against unauthorized access, alteration, disclosure, or destruction of information. You are responsible for maintaining the confidentiality of your password and should always log out and close your browser when you finish your session.

No security measures are perfect or impenetrable. As such, we cannot guarantee the absolute security of your information.

11. Use of Third-Party Analytics and Advertising Technologies

We may use third-party analytics and advertising tools on our Services to help understand user interactions, improve the user experience, and deliver personalized content and advertisements. These tools may include, but are not limited to, technologies such as Microsoft Clarity, Meta Pixel (Facebook Pixel), Google Analytics 3 (GA3), and Rb2b.

These tools may collect certain information automatically through cookies, pixel tags, or similar tracking technologies when you visit or interact with our Services. The data collected may include device identifiers, IP address (which may be anonymized or masked), browser and operating system details, user interactions (clicks, cursor movements, page visits), and aggregate usage statistics.
